1. Shameful: New York Times Columnist Nicholas Kristof Links Boston Explosion to GOP, Others Pile On
Never let a tragedy go to waste. New York Times columnist Nicholas Kristof on Monday quickly used the explosions in Boston for political gain, linking the Republican Party to the horrific act. At 4:10pm, Kristof tweeted, "explosion is a reminder that ATF needs a director. Shame on Senate Republicans for blocking apptment." Kristof then tweeted a link to a Washington Post story about Senator Charles Grassley questioning the fitness of Obama's Alcohol Tobacco and Firearms nominee. Kristof's comments earned a rebuke from the liberal Politico. Dylan Byers reported, "Kristof's tweet earned a number of responses expressing either anger or bafflement."


2. Chris Matthews: 'Normally' Domestic Terrorists 'Tend to Be on the Far Right'
Just hours after explosions rocked the Boston Marathon on Monday, Chris Matthews speculated, "Normally domestic terrorists, people, tend to be on the far right." He then reconsidered and suggested, "...That’s not a good category, just extremists, let’s call them that." During live coverage, the Hardball host highlighted a possible explosion at John F. Kennedy's presidential library and thought this could be a personal attack on the Democratic Party: "...But going after the Kennedy Library, not something at Bunker Hill, not something from the Freedom Trail or anything that kind of historic, but a modern political figure of the Democratic Party. Does that tell you something?" (Police are now considering the incident at the JFK library to be fire-related.) One can only guess what it tells Chris.


3. CBS Ends Blackout on Gosnell Trial, Spotlights How 'Firestorm' Went 'Viral'; ABC, NBC Still Out to Lunch
CBS finally ended their on-air coverage blackout of the Kermit Gosnell's murder trial on Monday's CBS This Morning, airing two segments on the story a month after opening arguments began. Jan Crawford acknowledged that the Gosnell case "has received little national news coverage". Meanwhile, ABC and NBC's morning and evening newscasts continue to ignore the ongoing legal proceedings against the abortionist. Crawford pointed out how conservatives "accused the media of ignoring the story because what it called a bias in favor of abortion rights", and how those "charges went viral on Twitter". She even played a sound bite from a former attorney for the murder suspect who questioned the national news media's lack of coverage of the trial.


4. NBC Mentions Criticism of Media Censoring Gosnell Abortion Case...On Its Website
While NBC News continued to ignore the trial of Philadelphia abortionist Kermit Gosnell on its airwaves, an NBCNews.com article posted Saturday made brief mention of the media blackout: "Conservative bloggers, including at RedState and National Review, have lashed out this week at national media organizations for not paying enough attention to the gruesome trial of a Philadelphia abortion provider accused of killing seven late-term fetuses after they were born alive." Careful to use the term "fetuses," rather than "infants" or "children," staff writer Erin McClam did not address the validity of the criticism or acknowledge the fact that her network has refused to give any air time to the trial.


5. ABC Is So Intent on Pushing Gun Control, the Network Twice Played Rival NBC's SNL Parody
ABC has aggressively pushed Barack Obama's gun control scheme in recent weeks. But on Sunday and Monday, the network resorted to playing clips of a rival channel's comedy show, Saturday Night Live. Sunday's World News and Monday's Good Morning America both touted Democratic talking points, lamenting how hard it is to get such legislation passed. On Monday morning, Jon Karl hyped, "Congress is just not eager to enact new gun laws. A fact lampooned on Saturday Night Live." He then featured a clip of comedian Jay Pharoah impersonating Obama. Pharoah mocked, "This week, the Senate voted 68-31 to begin debating the idea of discussing gun control. Let me say that again. They have agreed to think about talking about gun control." On Sunday's World News, reporter Rena Ninan didn't even bother coming up with much of a justification. She simply introduced, "Saturday Night Live, overnight."


6. Harrison Ford Tells NBC's Gregory Obama Doing 'Wonderful Job'; Blames Media for Political Divisiveness
At the end of an interview with actor Harrison Ford for the NBC Meet the Press web-based feature Press Pass, about his role in a new film about Jackie Robinson, host David Gregory turned to politics: "I know you're politically conscious, politically active. What is your view of the state of things, and the state of the President's performance?"  Ford replied: "I think the President is doing, you know, all things considered, a wonderful job." He then blamed the media for political division in country: "I wish that the country were not so fractious as it is at the moment. I blame a lot of that on the press and the news business. And I wish it wasn't so. And I think it makes things very difficult..."

Washington, Apr 5 - Remember when House Speaker Nancy Pelosi (D-CA) said last month “we have to pass the bill so that you can find out what is in it?” Tucked away inside President Obama’s new health care law is a controversial provision dramatically expanding taxpayer funding of contraceptives and the abortion industry. Washington Democrats actually tried to insert this legislative language in the original trillion-dollar ‘stimulus,’ but were forced to remove it under pressure from Republicans and the American people. No matter: Democrats just hid it in their government takeover of health care instead. After all, no liberal special interest giveaway could be spared in order to force this job-killing monstrosity through Congress over the objection of the American people.

Specifically, all states are now free to offer Medicaid “family planning” services – even for those who are not poor enough to qualify for Medicaid – without receiving approval from the federal government. This will pave the way for more taxpayer dollars to go to clinics that undercut parents and promote abortions. Inside Health Policy has the details:

"Tucked into the health reform legislation is a controversial provision allowing states to expand coverage for family planning services under Medicaid without a waiver from the federal government. Democrats had tried to insert the language into the Recovery Act in January 2009, but pulled back after it became a lightning rod for GOP attacks ... Sen. Debbie Stabenow (D-Mich.) championed the provision in the Senate, adding it to the Senate Finance Committee version of the legislation during mark-up, sources said, and Energy and Commerce Committee Chairman Henry Waxman (D-Calif.) pushed for it in the House. ... ‘How can you spend hundreds of millions of dollars on contraceptives? How does that stimulate the economy?’ House Minority Leader John Boehner (R-Ohio) said of the provision, according to Reuters.”

With a new national survey showing that even more Americans oppose the new health care law after its passage than before it, House Republican Leader John Boehner (R-OH) says this revelation will only make President Obama’s PR campaign even harder:

“President Obama’s new health care law is already hurting our economy by squeezing employers with job-killing tax hikes and health care cost hikes. Now we learn that Washington Democrats’ government takeover of health care dramatically expands taxpayer funding of contraceptives and the abortion industry. First Democrats removed this controversial provision from the ‘stimulus’ and then they hid it in their government takeover of health care, hoping the American people wouldn’t notice. That’s why Republicans are fighting to repeal this health care law and replace it with common-sense reforms that respect taxpayer dollars and protect life.”

The new health care law marks yet another failure on the part of President Obama and Democrats in Washington to deliver the open and honest government they promised. The final health care bill was signed into law roughly 36 hours after it was passed despite President Obama’s campaign promise that the public would have five days to review every bill that came to his desk “so that you know what your government’s doing.” What other giveaways to liberal special interest groups ended up hidden in this law? How much are these sweetheart deals costing American taxpayers, who are already on the hook for more than $12.7 trillion in debt?

The American people have a right to know how their hard-earned money is being spent. House Republicans have proposed a common-sense transparency initiative to make Congress more open and accountable to the people it serves.

Obama's executive order on abortion restrictions in the Patient Protection and Affordable Care Act

ENSURING ENFORCEMENT AND IMPLEMENTATION OF ABORTION RESTRICTIONS IN THE PATIENT PROTECTION AND AFFORDABLE CARE ACT

Today, the President announced that he will be issuing an executive order after the passage of the health insurance reform law that will reaffirm its consistency with longstanding restrictions on the use of federal funds for abortion.

While the legislation as written maintains current law, the executive order provides additional safeguards to ensure that the status quo is upheld and enforced, and that the health care legislation’s restrictions against the public funding of abortions cannot be circumvented.

The President has said from the start that this health insurance reform should not be the forum to upset longstanding precedent. The health care legislation and this executive order are consistent with this principle.

The President is grateful for the tireless efforts of leaders on both sides of this issue to craft a consensus approach that allows the bill to move forward.

A text of the pending executive order follows:

EXECUTIVE ORDER

ENSURING ENFORCEMENT AND IMPLEMENTATION OF ABORTION RESTRICTIONS IN THE PATIENT PROTECTION AND AFFORDABLE CARE ACT

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the “Patient Protection and Affordable Care Act” (approved March __, 2010), I hereby order as follows:

Section 1. Policy.
Following the recent passage of the Patient Protection and Affordable Care Act (“the Act”), it is necessary to establish an adequate enforcement mechanism to ensure that Federal funds are not used for abortion services (except in cases of rape or incest, or when the life of the woman would be endangered), consistent with a longstanding Federal statutory restriction that is commonly known as the Hyde Amendment. The purpose of this Executive Order is to establish a comprehensive, government-wide set of policies and procedures to achieve this goal and to make certain that all relevant actors—Federal officials, state officials (including insurance regulators) and health care providers—are aware of their responsibilities, new and old.

The Act maintains current Hyde Amendment restrictions governing abortion policy and extends those restrictions to the newly-created health insurance exchanges. Under the Act, longstanding Federal laws to protect conscience (such as the Church Amendment, 42 U.S.C. §300a-7, and the Weldon Amendment, Pub. L. No. 111-8, §508(d)(1) (2009)) remain intact and new protections prohibit discrimination against health care facilities and health care providers because of an unwillingness to provide, pay for, provide coverage of, or refer for abortions.

Numerous executive agencies have a role in ensuring that these restrictions are enforced, including the Department of Health and Human Services (HHS), the Office of Management and Budget (OMB), and the Office of Personnel Management (OPM).

Section 2. Strict Compliance with Prohibitions on Abortion Funding in Health Insurance Exchanges. The Act specifically prohibits the use of tax credits and cost-sharing reduction payments to pay for abortion services (except in cases of rape or incest, or when the life of the woman would be endangered) in the health insurance exchanges that will be operational in 2014. The Act also imposes strict payment and accounting requirements to ensure that Federal funds are not used for abortion services in exchange plans (except in cases of rape or incest, or when the life of the woman would be endangered) and requires state health insurance commissioners to ensure that exchange plan funds are segregated by insurance companies in accordance with generally accepted accounting principles, OMB funds management circulars, and accounting guidance provided by the Government Accountability Office.

I hereby direct the Director of OMB and the Secretary of HHS to develop, within 180 days of the date of this Executive Order, a model set of segregation guidelines for state health insurance commissioners to use when determining whether exchange plans are complying with the Act’s segregation requirements, established in Section 1303 of the Act, for enrollees receiving Federal financial assistance. The guidelines shall also offer technical information that states should follow to conduct independent regular audits of insurance companies that participate in the health insurance exchanges. In developing these model guidelines, the Director of OMB and the Secretary of HHS shall consult with executive agencies and offices that have relevant expertise in accounting principles, including, but not limited to, the Department of the Treasury, and with the Government Accountability Office. Upon completion of those model guidelines, the Secretary of HHS should promptly initiate a rulemaking to issue regulations, which will have the force of law, to interpret the Act’s segregation requirements, and shall provide guidance to state health insurance commissioners on how to comply with the model guidelines.

Section 3. Community Health Center Program.
The Act establishes a new Community Health Center (CHC) Fund within HHS, which provides additional Federal funds for the community health center program. Existing law prohibits these centers from using federal funds to provide abortion services (except in cases of rape or incest, or when the life of the woman would be endangered), as a result of both the Hyde Amendment and longstanding regulations containing the Hyde language. Under the Act, the Hyde language shall apply to the authorization and appropriations of funds for Community Health Centers under section 10503 and all other relevant provisions. I hereby direct the Secretary of HHS to ensure that program administrators and recipients of Federal funds are aware of and comply with the limitations on abortion services imposed on CHCs by existing law. Such actions should include, but are not limited to, updating Grant Policy Statements that accompany CHC grants and issuing new interpretive rules.

Section 4. General Provisions.
(a) Nothing in this Executive Order shall be construed to impair or otherwise affect: (i) authority granted by law or presidential directive to an agency, or the head thereof; or (ii) functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
(b) This Executive Order shall be implemented consistent with applicable law and subject to the availability of appropriations.
(c) This Executive Order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity against the United States, its departments, agencies, entities, officers, employees or agents, or any other person.

Today, Rep. Wasserman Schultz admitted to Fox News' Megyn Kelly that "an executive order cannot change the law."

The United States Conference of Catholic Bishops pointed out today that "only a change in the law enacted by Congress, not an executive order, can begin to address this very serious problem in the legislation."

BALTIMORE — Alliance Defense Fund attorneys and allied attorneys filed a lawsuit Thursday against the city of Westminster on behalf of pro-life organization Defend Life. Police insisted that participants in Defend Life’s “Face the Truth” 2008 tour needed permits to peacefully share their pro-life message along a public street.

“Pro-life advocates shouldn’t be penalized for expressing their beliefs. The government can’t require them to obtain permits to exercise their First Amendment rights,” said ADF Senior Legal Counsel Joel Oster.

In June, Defend Life Director Elizabeth Walsh and volunteers contacted the Westminster Police Department more than two weeks before their planned demonstration—making sure it was in adherence to the law. Police told them that they needed permits from the city and the Maryland State Highway Administration, as well as permission from the owner of a nearby shopping center. Subsequently, a police captain told Defend Life that its permit requests would be denied and refused to provide an explanation.

“Pro-lifers shouldn’t be denied their free speech rights simply because some people don’t approve of their message. That’s a textbook violation of the First Amendment,” said ADF-allied attorney Owen M. Taylor, who is assisting with the case.

Defend Life held its “Face the Truth” tour this summer throughout Maryland, the District of Columbia, and Northern Virginia. Participants wore pro-life T-shirts, held signs, and occasionally shared their message verbally along the road to motorists.

On Sept. 3, ADF attorneys filed a separate lawsuit on behalf of three young women who were arrested, jailed, shackled, and strip-searched after demonstrating on the last day of the Defend Life 2008 tour. A federal judge approved an agreement on Oct. 10 that prohibits enforcement of a permit requirement involved in that case while the court considers its constitutionality (

Group files free speech lawsuit against Westminster by Charles Schelle


Attorneys from the Alliance Defense Fund last week filed a suit on behalf of a pro-life group, Defend Life, against the City of Westminster contending that the city violated the group’s First and Fourteenth Amendment rights.

The disagreement is over a planned demonstration on July 30, 2008, by Defend Life as part of its “Face the Truth” tour to spread a pro-life message.

Defend Life is a non-profit, pro-life organization based in Baltimore. The group is seeking to get the city to change the wording of its ordinance regarding demonstrations, and also any damages prescribed by the court.

According to a copy of the lawsuit, filed Thursday, Oct. 23 in the District Court of Maryland, Elizabeth Walsh of Owings Mills, director of Defend Life’s tour, said the Westminster Police Department told the organization they would have to have permits from the city, State Highway Administration and permission of a shopping center located near the intersection of Route 140 and Englar Road in order to stage a demonstration.

However, the lawsuit contends that the SHA does not require such a permit, and the city did not grant the group a permit.

Defend Life says the requirements “chilled” the group’s free speech and equal protection rights.
