As Two Men Go Free, a Dogged Ex-Prosecutor Digs In - NYTimes.com

As Two Men Go Free, a Dogged Ex-Prosecutor Digs In - NYTimes.com:

NYT: In Lumberton NC – “As Two Men Go Free, a Dogged
Ex-Prosecutor Digs In” By RICHARD A. OPPEL Jr. SEPT. 7, 2014

LUMBERTON, N.C. — The most memorable moment of the trial
that put Henry McCollum and Leon Brown behind bars for three decades for a
hideous 1983 rape and murder was a display of brilliant courtroom theatrics.
District Attorney Joe Freeman Britt of Robeson County, who
stood 6-foot-6 and came to be known as America’s “Deadliest D.A.,” asked jurors
to try to hold their breath for five minutes — the time it took the 11-year-old
victim to choke to death, after her killer stuffed her panties down her throat
with a stick — to get a small sense of the horror she experienced.

The jury came back with two of the more than 40 death
penalty convictions Mr. Britt won over almost two decades.

Those two convictions were obtained on the basis of
inconsistent, soon recanted, confessions from two mentally impaired teenagers
who said they had been coerced to sign statements written by interrogators, and
testimony by an informer who previously did not implicate the two. They were
overturned last week, and Mr. McCollum and Mr. Brown were exonerated and set
free.

Attorney General Gansler to Sue Carroll Co Md Over Implementation of "Rain Tax"

Attorney General Gansler to Sue Carroll County
Legal Action Threatened Over Implementation of "Rain Tax"
Marylanders for Joe GettyNovember 14, 2013

Attorney General Douglas Gansler has threatened to sue the County Commissioners of Carroll County for their failure to implement the so-called "rain tax" passed by the Maryland General Assembly in 2012.

Gansler is also one of three Democrat candidates for Governor of Maryland in the June 24, 2014, primary election.

In a letter to the County Commissioners, the Attorney General's office threatens enforcement by "injunctive relief in a civil action or issue an order requiring the County to take corrective actions."  The enforcement action also could subject Carroll County to "civil penalties of up to $10,000 for each day of violation." (The entire letter from Assistant Attorney General Paul N. De Santis is posted on the website of the Carroll County Times click here.)

The threat of fines and legal action has also been covered by national organizations that research tax policy. The following commentary appeared in the blog American Legislator (for full article, click here):

"Maryland is no stranger to tax increases. In fact, since Governor O'Malley took office in 2007, there have been 40 tax, fee, and toll increases. The rain tax is another burden to add to the list. Given Maryland's dismal economic outlook rank of 35th in Rich States, Poor States, the Governor and legislators would be wise to re-think this destructive tax-and-spend approach to policymaking."

Federal judge rejects Perdue bid to recoup legal fees from Waterkeeper Alliance

Waterkeeper Alliance suit cost $3 million

Aug. 27, 2013 Written by Jeff Montgomery The News Journal

In a case closely watched by citizen advocacy and farm groups, a federal judge on Tuesday rejected a farm industry bid to collect $3 million in legal fees from a group that sued Perdue Farms and a family farm in 2010 over Pocomoke River water pollution.

U.S. District Court Judge William M. Nickerson tossed out the Waterkeeper Alliance’s Clean Water Act case last year, concluding in an opinion that the action was flawed and “not pursued or litigated as well as it could have been.”

“It is most unfortunate that so much time and so many resources were expended on this action that accomplished so little,” Nickerson wrote, adding later: “That, however, is not the same as concluding that the underlying claim was ‘frivolous, unreasonable or without foundation,’ or ever clearly became so.”

The Waterkeeper Alliance sued Perdue and the Alan and Kristin Hudson Farm near Berlin, Md., using a provision of the Clean Water Act to seek enforcement for what the group viewed as uncontrolled releases of poultry wastes... http://www.delawareonline.com/article/20130828/NEWS/308280047/Federal-judge-rejects-Perdue-bid-recoup-legal-fees?utm_source=Chesapeake+Bay+News&utm_campaign=800ca8d743-Chesapeake_Bay_News4_23_2013&utm_medium=email&utm_term=0_71ced15df1-800ca8d743-61679805

Colleen Vanderlinden: Michigan Woman Faces 93 Days in Jail for Planting a Vegetable Garden

Michigan Woman Faces 93 Days in Jail for Planting a Vegetable Garden

It just doesn't get more ridiculous than this.

Julie Bass of Oak Park, Michigan -- a mother of 6, law-abiding citizen, and gardener -- is facing 93 days in jail after being charged with a misdemeanor.

Her crime? Planting a vegetable garden in the front yard.

Bass says that she planted the garden after her front yard was torn up for some sewer repairs. Rather than wasting the opportunity to start with a clean slate by planting a lawn, she decided to really put the area to use, and plant a vegetable garden.

Her garden consists of 5 raised beds, where she grows a mix of squashes, corn, tomatoes, flowers, and other veggies. Bass received a warning from the city telling her to remove the vegetable garden, because it doesn't adhere to city ordinances (more on that later.) When she refused, she was ticketed and charged with a misdemeanor. Her trial, before a jury, is set to begin on July 26th. If she is found guilty, she can be sentenced to up to 93 days in jail.

Mitchelle Stephenson Westminster Patch: Crazy Maryland Laws You've Probably Violated

Crazy Maryland Laws You've Probably Violated

Did you ever look through your husband's pockets while he's asleep? That's illegal. So is taking a lion to the movies in Baltimore City.
&nbps;0 Comments
From the "Craziest Laws in America" blog—here are some wacky Maryland laws.
  • A woman may not go through her husband's pockets while he is sleeping.
  • Men may not buy drinks for female bartenders.
  • It is illegal to sell condoms from vending machines with one exception: prophylactics may be dispensed from a vending machine only "in places where alcoholic beverages are sold for consumption on the premises."
  • Thistles may not grow in one's yard.
  • Eating while swimming in the ocean is prohibited.
  • In the entire state, it is illegal to give or receive oral sex.
  • It is a violation to be in a public park with a sleeveless shirt, including joggers. $10 fine.
  • You cannot swear while inside the city limits of Baltimore.
  • Maryland requires that alcohol beverage writers be certified as experts by an agency of the state before they can receive product samples, which it limits to three bottles per brand.
  • Baltimore: Though you may spit on a city roadway, spitting on city sidewalks is prohibited.
