'Guns Kept People Alive' During The Civil Rights Movement | WAMU 88.5 - American University Radio:

"This year marks the 50th anniversary of many pivotal events in the civil rights movement, and to commemorate "Freedom Summer," Tell Me More is diving into books that explore that theme.

One of the cornerstones of the civil rights movement was non-violent resistance. During lunch counter sit-ins and protest marches Martin Luther King Jr. and other civil rights leaders instructed participants not to take up arms. Instead, when violence erupted or force was used to disrupt their activities, people would non-violently resist attempts by law enforcement to end the protest.

 But this passive resistance did not necessarily mean an unwillingness to use force to protect themselves from violence in other circumstances.

This hiding in plain sight story is recounted to NPR's Michel Martin by author, professor and former Student Nonviolent Coordinating Committee field secretary Charles E. Cobb Jr. in his new book, This Nonviolent Stuff'll Get You Killed: How Guns Made the Civil Rights Movement Possible."

The Justice Department is updating a report on how many guns the federal government has.

It will be the first time Justice has addressed the topic in six years, and it comes as conservative and libertarian complaints about an excessively gun-happy government have intensified.

The issue was central to the recent controversy generated by a stand-off between right-wing rancher Cliven Bundy and agents from the Bureau of Land Management in Nevada.

BALTIMORE – Maryland residents do not have to provide a "good and substantial reason" to legally own a handgun, a federal judge ruled Monday, striking down as unconstitutional the state's requirements for getting a permit.

Tn Woman Faces 3 1/2 Years In Prison For Bringing Her LICENSED Gun To The 9/11 Memorial


A tourist from Tennessee was standing in line to visit the 9/11 Memorial in lower Manhattan when she noticed a sign saying "no guns allowed."

The woman is licensed to carry a gun in her home state and she had it with her. Trying to follow the posted signs, she asked security guards where she could check the firearm in her purse. Find out what happened next HERE.

Smigiel’s Regulated Firearms Reciprocity Bill Introduced Again

Delegate Mike Smigiel has re-filed  a reciprocity bill for concealed carry permits from contiguous states. “In reflecting on the recent tragedy in Tuscon it is important to realize that one of the men who helped to disarm the gunman possesses a concealed carry permit. Joe Zamudio helped to restrain the gunman while others took his gun and ammunition. Mr. Zamudio was carrying a concealed weapon at the time he ran towards the gunman and you have to ask yourself, would he have felt as comfortable helping to restrain the gunman if he was not armed himself?”

HB 9 would allow for citizens from Delaware, Virginia, Pennsylvania and West Virginia to travel to Maryland and contribute to the economy with the freedom to carry the the weapons they were issued permits for in their home state. Neighboring states currently recognize firearm and concealed carry permits from other states. Delegate Smigiel has received numerous letters and testimony in support of the reciprocity law from Maryland citizens as well as citizens from neighboring states. “Maryland recognizes out of state driver’s licenses and even though Maryland does not issue marriage licenses to same sex couples, the Attorney General has opined that Maryland would have to recognize same sex marriages performed in other states. So if we recognize out of state drivers licenses and may have to recognize same sex marriage licenses from other states, then why wouldn’t we recognize a license to carry a concealed weapon or firearm from another state as well?” asked Delegate Smigiel.

Delegate Smigiel is very optimistic about  House Bill 9 this session, “HB 52 was a victory in that it was the first time a pro concealed carry bill was able to get out of the Committee Chairman’s drawer for a vote even though it eventually lost in an 11-10 vote in the Judiciary committee. I was proud of the widespread support which this legislation gained last year and expect HB 9 will continue to gain momentum during this session,”said Delegate Smigiel.

One of the first hearings in Judiciary Committee this session will be on HB 9 which is scheduled to be heard on January 25th at 1PM. On February 10th, several men of Westminster met in Lewis Hall, at the (
McDaniel College – then known as Western Maryland College,) and formed the Westminster Rifle Club, and elected officers as follows: Captain E. G. Smith, president; S. S. Wilson, vice-president; J. Albert Mitten, secretary; H. L. Hobby, treasurer, and J. Carberry Boyle, executive officer.

The purpose of this organization is to learn how to shoot the rifle and revolver and it will be a part of the National Rifle Association.

For the present the indoor range at the College will be used, but the range at the Armory is better and application will be made with the proper authorities for the use of it.

Next Monday night a shooting match will be held with the idea of picking a team to beat the College team. Members are to meet at the Red Front Store at 7:45 and transportation will be furnished to the College range. Members be ready.

How much should the Heller lawyers be paid for winning the case against the DC gun law?

A controversy is growing over the proper payment of the three lawyers who handled the Heller case that result in the DC gun law being struck down as unconstitutional.
The trio make their case today in the Examiner.

Prevailing parties in civil rights cases are entitled to a "reasonable" attorney's fee. We are the attorneys who represented Dick Heller in the landmark Supreme Court case striking down Washington, D.C.'s handgun ban on Second Amendment grounds, and we have asked the court to award us $3.5 million for six years of litigation.

The Washington Post has characterized that request as "adding insult to injury" and a "windfall" to which we are not entitled. The Post's editorial is long on rhetoric but short on analysis. In fact, the $3.5 million request is perfectly reasonable under existing court precedent.

The purpose of the fee-shifting provision is to ensure "vigorous enforcement" of civil rights laws, especially when monetary damages are not available and the claimants may not be able to afford competent legal counsel. To attain that goal, prevailing lawyers should receive a market rate for their efforts.

With respect to our recorded hours, the total was under 3,100 for three lawyers over six years. No reasonable person could consider those hours excessive, particularly considering that we were up against more than a dozen lawyers – some of them eminent Supreme Court practitioners – from the D.C. Attorney General's office and three of the nation's largest and most elite law firms.
