Carroll County Times - Christian Alexandersen: Senator hopes to repeal fortune telling ban

Soothsayers may soon be able to bring their palm and card reading talents to Carroll County if one state senator has his way.
Sen. Joseph Getty, R-District 5, said he was asked by Ariel Harper Nave, an astrologer from Westminster, to introduce legislation that repeals the county's ban on fortune tellers.
During a meeting with the Carroll County Board of Commissioners and the Carroll delegation of the General Assembly Tuesday, Getty said legislation should be introduced this session to make changes to the county's code.
Carroll's code says "a person may not demand or accept payment or gratuity to forecast or foretell, or pretend to forecast or foretell the future of another person by: 1. reading a card; 2. reading the palm of a hand; or 3. any other scheme, practice or device."

Katherine Heerbrandt: Toppings Pizza owner asked to pay $200,000 for unsolicited faxes


A Frederick County restaurateur said he is in danger of losing his business, but not because of a downturn in the economy.

Rather, he said his livelihood is threatened by what he terms "a frivolous lawsuit filed by a serial plaintiff."

Ken Nelson, president of Toppings Pizza Company in Frederick, is being asked to pay $200,000 in damages and legal fees for allegedly faxing lunch specials to another business in violation of federal and state Telephone Consumer Protection acts, which restricts the use of fax machines to send unsolicited advertisements.

Nelson denies the claim, and has been fighting it for four years. The Frederick County Circuit Court decided the case in Nelson's favor in 2009, but the case was appealed to the Maryland Court of Special Appeals on a technicality. The Court of Special Appeals kicked it back to Circuit Court where it is scheduled for trial on Oct. 27.

"This has gone on for nearly four years," Nelson said. "Why are we still in court for faxes?"

Superintendent says therapy duck is no longer allowed in classroom after finding feathers in the ventilation system.


At least one popular member of Hathaway Elementary Schoolwill not return to the classroom this year.
Lemon the Duck, the well-known Pekin duck born with a neurological condition, will not be housed this year inside the second-grade classroom of Laura Backman.
The superintendent has asked Backman, who is the owner of Lemon and a second-grade teacher, to house the duck outside after discovering feathers in the school's ventilation system. Some of the feathers have traveled to other classrooms, said Superintendent of Schools Dr. Susan Lusi.
"It (the feathers) travels to the other rooms," Lusi said. "We would have no problem with Lemon being at the school, as long as she is kept outside."
According to Lusi, Lemon was housed several years ago in an outdoor pen at Mellville Elementary School due to another teacher's allergy to duck feathers.
At the time, Backman says, she had many opportunities to visit with Lemon and take children out at recess to visit. At Hathaway, that is simply not the case.
"I'm happy they are willing to have her outside, but that's not good enough," Backman said. "They don't understand the positives of having her in the classroom."

Michael Clauer is a captain in the Army Reserve who commanded over 100 soldiers in Iraq. But while he was fighting for his country, a different kind of battle was brewing on the home front. Last September, Michael returned to Frisco, Texas, to find that his homeowners' association had foreclosed on his $300,000 house—and sold it for $3,500. This story illustrates the type of legal quagmire that can get out of hand while soldiers are serving abroad and their families are dealing with the stress of their deployment. And fixing the mess isn't easy.

That was why she missed multiple notices from the Heritage Lakes Homeowners Association informing her that the family owed $800 in dues—and then subsequent notices stating that the HOA was preparing to foreclose on the debt and seize the home.

At no point did anyone from the HOA—which is, after all, composed of the Clauers' neighbors—appear to have tried to visit May Clauer's house to talk to her about the problem. "The HOA board members...don't live very far from me at all," Michael Clauer says. There were "neighbors owing much more than us [who] were notified in person of pending foreclosures, but my wife only received a few letters." There are a bevy of laws that are supposed to protect servicemembers from losing their homes or jobs while they're on active duty, including the Servicemembers Civil Relief Act (SCRA). The homeowners' association's lawyer filed an affidavit wrongly claiming that neither of the Clauers was on active duty, says Barbara Hale, the couple's lawyer...

In the 15 months since Chicago-based Tribune Co. filed for bankruptcy, law firms and other professionals have billed the media conglomerate $138 million, or about one-quarter of the company's cash flow last year. E&P: Top lawyers in the case are billing at rates of $925 to $955 an hour, just below the $1,000 an hour rate that U.S. Bankruptcy Judge Kevin Carey, overseeing the case, suggested would try his patience.

Dear Ms. Coulter,

I understand that you have been invited by University of Ottawa Campus Conservatives to speak at the University of Ottawa this coming Tuesday. We are, of course, always delighted to welcome speakers on our campus and hope that they will contribute positively to the meaningful exchange of ideas that is the hallmark of a great university campus. We have a great respect for freedom of expression in Canada, as well as on our campus, and view it as a fundamental freedom, as recognized by our Canadian Charter of Rights and Freedoms.

I would, however, like to inform you, or perhaps remind you, that our domestic laws, both provincial and federal, delineate freedom of expression (or "free speech") in a manner that is somewhat different than the approach taken in the United States. I therefore encourage you to educate yourself, if need be, as to what is acceptable in Canada and to do so before your planned visit here.

You will realize that Canadian law puts reasonable limits on the freedom of expression. For example, promoting hatred against any identifiable group would not only be considered inappropriate, but could in fact lead to criminal charges. Outside of the criminal realm, Canadian defamation laws also limit freedom of expression and may differ somewhat from those to which you are accustomed. I therefore ask you, while you are a guest on our campus, to weigh your words with respect and civility in mind.

There is a strong tradition in Canada, including at this university, of restraint, respect and consideration in expressing even provocative and controversial opinions and urge you to respect that Canadian tradition while on our campus. Hopefully, you will understand and agree that what may, at first glance, seem like unnecessary restrictions to freedom of expression do, in fact, lead not only to a more civilized discussion, but to a more meaningful, reasoned and intelligent one as well.

The life of a true American warrior is on the line, Captain Carl Bjork U.S. Army Infantry Officer, my former platoon leader in Iraq, and my brother and friend for eternity, tomorrow morning begins the defense for his life in an American military courtroom in Baghdad for a crime he did not commit.

The U.S. Army has wrongly charged Carl with premeditated double murder committed during our 2006-2007 deployment to Hit, AlAnbar Province, Iraq.

This ludicrous charge is based off of the supposed eye-witness testimony of 3 detained Iraqi insurgents.

For 3 yrs the Army has been investigating Carl and the only evidence of this "crime" the prosecution is bringing to trial is the testimony of these 3 arrested terrorists, THE ONLY EVIDENCE!!!!

This is how our military supports its truly honorable veterans. Carl embodied everything an Army Infantry Officer should be. He tactically led my platoon by example on every mission, supported the interests of his soldiers in the politics of an infantry battalion, and appreciated the dangerous and hard work we did for him, for the work we did for the average Iraqi citizen, and for the work we did for our country-despite that work ever being known and most times not appreciated.

As a world traveler with an ever itching curiosity in foreign cultures Carl ALWAYS confronted the local Iraqi population with the utmost respect and reverence, accepting their customs and defending them against the common ignorant held prejudices of the average American.

My respect and admiration for Islam and the people of the Middle East was greatly influenced by the open-mindedness and human compassion displayed by my Leader and Friend Carl Bjork.

Despite fighting in one of the bloodiest battlegrounds, in the most violent province( Al Anbar was touted as being "LOST" by our wonderful left-wing media as we started our deployment)of Iraq, Carl never wavered in being a thoughtful, caring, humane human being.

HE DID NOT COMMIT THIS CRIME!!!

Please pass Carl's horrible and shameful situation on to everyone you know! PLEASE contact your local media outlets to bring the deserved media attention Carl's situation calls for!

TUSR has followed this case since its inception, and, based on available facts, we have openly advocated for redress for the captain. Bjork will face trial on murder charges. Bjork’s sister Erica sums the situation up: “[C]arl was sent back to the States and was told that he was under investigation for a double murder that occurred during his 2006-2007 deployment in Hit, Al Anbar Province, Iraq. His accusers, who are the only witnesses/evidence in this alleged crime, are four disgraced former Iraqi police who are imprisoned for the murder of two Iraqi civilians – believed to be Iraqi al queda.[sic]”

According to Erica, the captain was not present at the alleged murder—“He simply trained the Iraqi police as part of his duty.”

Not much is really known, apart from that. We do know those who grew up with or fought with Bjork hold him in the highest regard. A Facebook group formed to
support Bjork has grown to 7, 983 members.

Bjork’s primary accuser is a man named Col. Ibrahim Hamid Jaza. Yon unravels events in Iraq that caused Jaza to morph from hero to villain. Yon describes Jaza’s contributions to eliminating AQI (al Qaeda Iraq) from the region and he offers an interesting aside—AQI, said Yon, “beheaded Hamid’s son on a soccer field in the center of Hit in 2005.”

1958 - Vice Principal comes over, looks at Jack's shotgun, goes to his car and gets his shotgun to show Jack.

2008 - School goes into lock down, FBI called, Jack hauled off to jail and never sees his truck or gun again. Counselors called in for traumatized students and teachers.

20080108 The annual Stella Awards

It's time again for the annual "Stella Awards"! For those unfamiliar with these awards, they are named after 81-year-old Stella Liebeck who spilled hot coffee on herself and successfully sued the McDonald's in New Mexico where she purchased the coffee. You remember, she took the lid off the coffee and put it between her knees while she was driving. Who would ever think one could get burned doing that, right?

That's right; these are awards for the most outlandish lawsuits and verdicts in the
U.S. You know, the kinds of cases that make you scratch your head. So keep your head scratcher handy.

Here are the Stella's for the past year:



7TH PLACE:

Kathleen Robertson of Austin, Texas was awarded $80,000 by a jury of her peers after breaking her ankle tripping over a toddler who was running inside a furniture store. The store owners were understandably surprised by the verdict, considering the running toddler was her own son.

6TH PLACE:

Carl Truman, 19, of Los Angeles, California won $74,000 plus medical expenses when his neighbor ran over his hand with a Honda Accord. Truman apparently didn't notice there was someone at the wheel of the car when he was trying to steal his neighbor's hub caps.

Go ahead, grab your head scratcher.

5TH PLACE:

Terrence Dickson, of Bristol, Pennsylvania, was leaving a house he had just burglarized by way of the garage. Unfortunately for Dickson, the automatic garage door opener malfunctioned and he could not get the garage door to open. Worse, he couldn't re-enter the house because the door connecting the garage to the house locked when Dickson pulled it shut. Forced to sit for eight, count 'em, EIGHT, days on a case of Pepsi and a large bag of dry dog food, he sued the homeowner's insurance company claiming undue mental Anguish. Amazingly, the jury said the insurance company must pay Dickson $500,000 for his anguish. We should all have this kind of anguish.

4TH PLACE:

Jerry Williams, of Little Rock, Arkansas, garnered 4th Place in the Stella's when he was awarded $14,500 plus medical expenses after being bitten on the butt by his next door neighbor's beagle - even though the beagle was on a chain in its owner's fenced yard. Williams did not get as much as he asked for because the jury believed the beagle might have been provoked at the time of the butt bite because Williams had climbed over the fence into the yard and repeatedly shot the dog with a pellet gun.

Grrrrr ... Scratch, scratch.

3RD PLACE:

Third place goes to Amber Carson of Lancaster , Pennsylvania because a jury ordered a Philadelphiarestaurant to pay her $113, 500 after she slipped on a spilled soft drink and broke her tailbone. The reason the soft drink was on the floor: Ms. Carson had thrown it at her boyfriend 30 seconds earlier during an argument. What ever happened to people being responsible for their own actions?

Scratch, scratch, scratch. Hang in there; there are only two more Stellas to go...

2ND PLACE:


Kara Walton, of Claymont, Delaware sued the owner of a night club in a nearby city because she fell from the bathroom window to the floor, knocking out her two front teeth. Even though Ms. Walton was trying to sneak through the ladies room window to avoid paying the $3.50 cover charge, the jury said the night club had to pay her $12,000....oh, yeah, plus dental expenses. Go figure.


1ST PLACE: (May I have a fanfare played on 50 kazoos please?)

This year's runaway First Place Stella Award winner was Mrs. Merv Grazinski, of Oklahoma City, Oklahoma, who purchased a new 32-foot Winnebago motor home. On her first trip home from an OU football game, having driven onto the freeway, she set the cruise control at 70 mph and calmly left the driver's seat to go to the back of the Winnebago to make herself a sandwich. Not surprisingly, the motor home left the freeway, crashed and overturned. Also not surprisingly, Mrs. Grazinski sued Winnebago for not putting in the owner's manual that she couldn't actually leave the driver's seat while the cruise control was set. The Oklahoma jury awarded her, are you sitting down, $1,750,000 PLUS a new motor home. Winnebago actually changed their manuals as a result of this suit, just in case Mrs. Grazinski has any relatives who might also buy a motor home.

Are we, as a society, getting more stupid...????

WASHINGTON, Wednesday, August 08, 2007 — Today, Johnson & Johnson (J&J) filed a lawsuit against the American Red Cross and four of its licensing partners for “unlawful conduct” related to the nonprofit's use of the Red Cross emblem.

Specifically, J&J demands that the Red Cross:

Stop the Red Cross and its licensing partners from using the Red Cross emblem permanently on first aid, preparedness and related products sold to the public;

Surrender to J&J for destruction the Red Cross' inventory of accused products;

Hand over to J&J all Red Cross proceeds from the sale of these products with interest; and

Pay punitive damages to J&J along with attorney fees related to its legal action against the Red Cross.

“For a multi-billion dollar drug company to claim that the Red Cross violated a criminal statute that was created to protect the humanitarian mission of the Red Cross—simply so that J&J can make more money—is obscene,” said Mark W. Everson, President and CEO of the American Red Cross.

Research has found that only seven percent of Americans have taken the necessary steps to be prepared—and that more people would get prepared if preparedness products were more available, including at retail locations. Since 2004, the Red Cross has worked with several licensing partners to create first aid, preparedness and related products that bear the Red Cross emblem.

All money the Red Cross receives from the sale of these products to consumers is reinvested in its humanitarian programs and services.

This is a list of crazy laws in American history. Most of the laws listed below were repealed by now but there are many crazy laws on the list that are still being used....  


Maryland
  • Baltimore City: Though you may spit on a city roadway, spitting on city sidewalks is prohibited. You may not curse inside the city limits.
  • Baltimore: It's illegal to throw bales of hay from a second-story window within the city limits. It's illegal to take a lion to the movies. It is a park rule violation to be in a public park with a sleeveless shirt. $10 fine. This would include joggers that go shirtless. (1898) -Park Rule 6 It is a violation of city code to sell chicks or ducklings to a minor within 1 week of the Easter holiday.
  • Baltimore has regulations governing the disposal of hog's heads, pet droppings and oyster shells.
  • Columbia: You can not have a antenna exposed outside of your house yet you can have a 25' satellite dish. Though clotheslines are banned, clothes may be draped over a fence.
  • Eating while swimming in the ocean is prohibited.
  • Gypsies should steer clear of Caroline County, Md., where it's a $100 fine or six months in the can for "forecasting or pretending to foretell the future."
  • In Baltimore it's illegal to block the sidewalk with a box. But the offense only carries a $1 fine. Another law makes it illegal to throw bale of hay (or of anything else) out a second-story window. That gets you a $20 fine. In Baltimore it's illegal to play professional croquet before 2 p.m. Sunday. The law also applies to professional quoits.
  • In Baltimore it is illegal to mistreat oysters.
  • In Baltimore, it is illegal to wash or scrub sinks no matter how dirty they get.
  • In Baltimore, Maryland, it is not legal to take a lion to the movies.
  • In Halethrope, Maryland kisses longer than one second are illegal.
  • In Maryland, a woman may not go through her husband's pockets while he is sleeping.
  • In Maryland, men may not buy drinks for female bartenders.
  • In Maryland, it is illegal to sell condoms from vending machines with one exception: prophylactics may be dispensed from a vending machine only "in places where alcoholic beverages are sold for consumption on the premises."
  • In Maryland, the legislature once proposed a board of parachute examiners to be made up of five licensed parachute instructors who would test and license all other parachute instructors. The plan had been abandoned when it was learned there were only three licensed parachute instructors in the state.
  • In the entire state of Maryland, it is illegal to give or recieve oral sex.
  • It is a violation to be in a public park with a sleeveless shirt. $10 fine.
  • Maryland now requires that alcohol beverage writers be certified as experts by an agency of the state before they can receive product samples, which it limits to three bottles per brand.
  • Ocean City: A law from the early 1900's prohibits men from going topless on the Boardwalk. Eating while swimming in the ocean is prohibited
  • Thistles may not grow in one's yard.
  • You cannot swear while inside the city limits of Baltimore.
