Kevin E. Dayhoff, March 22, 2016 - I do not think that I am going to write about this - so what the heck... I have written a great deal about the local, state and federal judiciary in the past, including covering conferences on the courts and its historic relationship with the presidency. So if I end-up writing an article, please feel free to throw this comment in my face. Whatever.

Although one cannot fully predict the decisions and judicial temperament of an individual once a justice takes a seat on the bench, all indications are that Merrick Garland would be a fine justice.

It is a basic in politics that if you go nuclear with your initial response and approach, it denies you a fall-back position. It is a basic that if you are going to undermine an opponent’s position, you do not telegraph your intentions.

The approach of the current Republican leadership towards appointing a justice to replace Associate Justice of the Supreme Court of the United States Antonin Gregory Scalia, 1986-2016, is amateurish at best.

And at this point, if things continue in its current trajectory, the next president will be President Clinton. And she will have the benefit of a Democrat controlled Senate because if things continue the way they are going, the Senate will flip to the Democrats in the next election.

So - this might be the most wrong-headed political approach towards governance in memory - maybe since President F.D. Roosevelt tried to pack the court.... Bring back the monarchy.

Post script: If the Senate moves 11 seats to the Democrats, President Obama could very easily be narrowly confirmed as a justice of the Supreme Court - all as courtesy of the current leadership of the Republican Party. SMH. For me it is a win-win. I get to write about it.

Trump will not prevail against Clinton. If I were a conspiratorialist, I would suggest that Trump's candidacy was brought forward by a secret cabal of Democrat party elites. Senate Majority Leader Mitch McConnell said Wednesday that Republicans won’t hold hearings on Judge Merrick Garland, President Obama’s nominee to replace Antonin Scalia on the Supreme Court. If McConnell follows through and makes everyone wait until next year, he and his party will be taking a serious risk. The political situation for Republicans could get a lot worse — and McConnell might no longer be in charge of the Senate.

The logic of this isn’t that complicated. Right now, the most likely person to become the next president is Hillary Clinton, who is on the verge of wrapping up the Democratic nomination. The second most likely person is Donald Trump. His path to the Republican nomination is more tenuous than Clinton’s path to the Democratic one. But Trump had a successful day of elections on Tuesday — and if it isn’t obvious how Trump will get to 1,237 delegates, it’s even less obvious how anyone else will become the Republican nominee.

The Supreme Court says prayers that open town council meetings do not violate the Constitution even if they routinely stress Christianity. The ruling is consistent with past decisions about prayer in public places. In 1983, the court upheld an opening prayer in the Nebraska legislature and said that prayer is part of the nation's fabric, not a violation of the First Amendment.

Supreme Court Allows Opening Prayer at Town Board Meeting
The Supreme Court on Monday ruled that a town in upstate New York may begin its public meetings with a prayer from a “chaplain of the month.”
Justice Anthony M. Kennedy, writing for the majority in the 5-to-4 decision, said “ceremonial prayer is but a recognition that, since this nation was founded and until the present day, many Americans deem that their own existence must be understood by precepts far beyond that authority of government to alter or define.”
In dissent, Justice Elena Kagan said the town’s practices could not be reconciled “with the First Amendment’s promise that every citizen, irrespective of her religion, owns an equal share of her government.”
Town officials said that members of all faiths, and atheists, were welcome to give the opening prayer. In practice, the federal appeals court in New York said, almost all of the chaplains were Christian.

Washington Post National News Alert

The Supreme Court struck down as unconstitutional the 1996 Defense of Marriage Act that denies federal benefits to same-sex couples who are legally married in the states where they reside. The court said it violated equal protection to provide benefits to heterosexual couples while denying them to gay couples in the 12 states plus the District of Columbia where same-sex couples may marry. The law passed by bipartisan majorities in Congress and signed by President Bill Clinton recognized marriage as only between one man and one woman.

The U.S. Supreme Court this morning upheld Maryland's new congressional map, clearing up one last legal question and affirming that the state's prison population can be counted at their last known address.

Republican lawmakers are trying to gather enough signatures to put the congressional map on the ballot this fall. WASHINGTON—(MCT)The U.S. Supreme Court sharply criticized public-sector unions for using money from nonmembers to fund special political campaigns, stepping into the intense political debate about such unions and signaling that new constitutional limits may be coming.

The justices ruled Thursday that the Service Employees International Union in California violated the First Amendment rights of its dissident members by taking extra fees from their paychecks in 2005. The money was used to fight two anti-union ballot measures.

"This aggressive use of power by the SEIU to collect fees from nonmembers is indefensible," said Justice Samuel A. Alito Jr., speaking for the court's majority. "When a public-sector union imposes a special assessment or dues increase, the union ... may not exact any funds from nonmembers without their affirmative consent."

The court fight carried echoes of the recent battles in Wisconsin, Ohio and other states where Republican governors sought to limit the power of public-sector unions, and the two dissenters Thursday made reference to those tensions… http://www.jewishworldreview.com/0612/supreme_court_unions.php3

The Supreme Court gave an Idaho couple another chance Wednesday to challenge a government ruling barring construction of their "dream house," an important property rights defeat for the Obama administration.

The justices unanimously ruled Chantell and Mike Sackett can appeal a compliance order that said wetlands on their residential lot were improperly filled with rocks and dirt. A building permit was then revoked. ...

"The Supreme Court has come to our rescue," Mike Sackett said just after the decision was issued, "and reminded the EPA — and everyone — that this is still America, and Americans still have rights under the Constitution."

Supreme Court Steps In to Review Texas Redistricting

The Supreme Court on Friday evening agreed to hear a tangle of lawsuits over how elections in Texas next year for its state legislature and for Congress are to be conducted.

The court stayed orders from a special three-judge court in San Antonio, Texas, which had issued electoral maps late last month that seemed to help Democrats and Hispanic voters.

The justices ordered the parties to file briefs on a brisk schedule, and they will hear arguments on Jan. 9. The Supreme Court must move quickly if next year’s primary and general elections are to proceed in an orderly way.

Friday’s order did not say what election officials in Texas are meant to do in the meantime. Primaries are scheduled for March, and candidates have been filing under the court-drawn maps...

The Supreme Court decision introduced the matter as follows:

For the past 20 years, the congregation of the Westboro Baptist Church has picketed military funerals to communicate its belief that God hates the United States for its tolerance of homosexuality, particularly in America’s military.  The church’s picketing has also condemned the Catholic Church for scandals involving its clergy.  Fred Phelps, who founded the church, and six Westboro Baptist parishioners (all relatives of Phelps) traveled to Maryland to picket the funeral of Marine Lance Corporal Matthew Snyder, who was killed in Iraq in the line of duty.  The picketing took place on public land approximately 1,000 feet from the church where the funeral was held, in accordance with guidance from local law enforcement officers.  The picketers peacefully displayed their signs—stating, e.g., “Thank God for Dead Soldiers,” “Fags Doom Nations,” “America is Doomed,” “Priests Rape Boys,” and “You’re  Going to Hell”—for about 30 minutes before the funeral began.  Matthew Snyder’s father (Snyder), petitioner here, saw the tops of the picketers’ signs when driving to the funeral, but did not learn what was written on the signs until watching a news broadcast later that night… http://www.supremecourt.gov/opinions/10pdf/09-751.pdf

Matthew Snyder, of Finksburg, Maryland, died from a non combat-related vehicle accident in Al Anbar province, Iraq. He was assigned to Combat Service Support Group-1, 1st Marine Logistics Group, I Marine Expeditionary Force, Twentynine Palms, California. Died on March 3, 2006. Matthew was 20 years old.


Matthew graduated from Westminster High School in 2003.
