The ACLU has taken up the cause of a Maryland motorcyclist who is facing wiretapping charges for making a video of a traffic stop by a Maryland state trooper that he later posted on YouTube.

Graber was wearing a helmet mounted camera when a state trooper in an unmarked car pulled in front of his motorcycle on March 5, jumped out with his gun drawn and began yelling before identifying himself as a police officer. After Graber posted the video of his encounter on YouTube it received widespread media attention for what appeared to be the officer’s hostile demeanor during a routine traffic stop.

But the Maryland State police struck back, charging Graber with recording the incident without the officer’s consent, a move that has put police at odds with first amendment the ACLU said.

“Police officers doing their jobs in a public place, such as an interstate highway, cannot reasonably claim that their communications are private, “said ACLU Legal Director Deborah Jean. “This is especially true for highway stops, since many police departments – including the Maryland State Police – record the stops themselves, thus negating any possibility that the officer would reasonably believe the conversation to be private.”

State police also executed a search warrant at Graber’s home several weeks ago, taking all his personal computers and audio visual equipment.
